In connection with Art. 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC we hereby inform that:
Controller of Customer personal data and contact
The controller of your personal data is the company Just and Gal sp. z o.o. with its registered office in Warsaw (02-945), Świętego Bonifacego 92/15, e-mail: email@example.com, hereinafter referred to as “SETA”.
The purpose and legal basis of processing personal data
Your personal data are processed for the purpose of performing the concluded Contract of Sale to the extent necessary to the fulfilment of the contract, including provision of services by electronic means, establishment of an account in the SETA Online Shop, processing of complaints and returns and establishing contact with you on the basis of Art. 6(1)(b) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC. General law provisions require also that your personal data be used for taxation and accounting purposes.
Upon your consent SETA shall process your personal data in order to send commercial information (Newsletter) to the provided e-mail address on the basis of Art. 6(1)(a) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.
Your personal data are processed for a legitimate legal interest of SETA in the context of the application of cookies for the purpose of storing your preferences and settings in the Online Shop as well as collecting anonymous information for commercial and statistical purposes.
Is the Customer obliged to provide the required personal data?
You provide us with your personal data while setting up your Online Shop account and placing orders. The provision of these personal data is necessary to conclude and perform the contract. We may also require that you provide us with your other personal data i.e. for taxation and accounting purposes if required by general law provisions.
The provision of an e-mail address is necessary to receive Newsletters.
Right to process personal data
You have the right to access your personal data, rectify them, demand their erasure if there are no grounds for their processing, restrict their processing as well the right to transfer them and to lodge a complaint with a Personal Data Protection Competent Authority (Polish: PUODO – President of the Personal Data Protection Office).
In the context of sending Newsletters the processing of personal data is performed upon your consent, therefore in addition to the aforementioned you also have the right to withdraw your consent at any time with effect for the future.
You also have the right to object to the processing of your personal data if it is carried out on grounds of a legitimate legal interest as well as when they are processed for the purposes of direct marketing, including through profiling.
To whom are data made available?
The recipients of Customer personal data are entities supporting SETA with regard to the provision of services by electronic means, including payment, IT, financial, accounting and delivery services.
Storage period of personal data
Personal data are stored to the necessary extent for the time the contract is performed and the limitation period is applicable to the claim arising form this contract as well as compliance with legal duties is being ensured, including fulfilling taxation and accounting obligations.
In the case of Newsletter, personal data will be processed until you’ve withdrawn your consent.
Are your personal data processed automatically (including through profiling)?
Your personal data will be processed automatically, including through profiling; however, this will neither produce any legal effects concerning you nor affect you in any significant way. Profiling consists in processing your personal data mainly to analyze your preferences and to develop the Online Shop.
